1. About These Terms and Who We Are
These Terms of Service (“Terms”) apply to your use of the website kesalzmentors.help (the “Website”) and to the tuition services provided by Kesal Mentors (“Kesal Mentors”, “we”, “us” or “our”), a private tuition service based in London, United Kingdom. In these Terms, “you” means the parent, guardian or adult student who books tuition with us or uses the Website.
Please read these Terms carefully before booking. If you are a consumer, you have legal rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms affects those rights. You can contact us at any time at support@kesalzmentors.help.
2. Using This Website
You may use the Website to find out about our tuition services and to send us an enquiry. When you use it, please:
- give accurate information in our enquiry forms;
- not try to gain unauthorised access to the Website or interfere with how it works; and
- not use our forms to send spam or unlawful, offensive or misleading content.
We try to keep the Website available and accurate, but we may update, suspend or change it at any time. Information on the Website is general and does not form part of a tuition agreement unless we confirm it to you in writing.
3. Our Tuition Services
We offer private tuition in Maths, English and Science for Primary (KS1–KS2), Secondary (KS3–KS4) and Sixth Form (Years 12–13) students and Adult Learners, provided as:
- 1-to-1 home tuition in London; and
- online tuition for students across the UK.
What is included in your tuition, such as the subject, level, lesson length, how often lessons take place and whether they are at home or online, will be agreed with you before lessons start.
4. Enquiries and Bookings
Sending an enquiry or requesting a consultation through the Website does not create a booking or commit you to paying for anything. After we discuss the student’s needs, we will send you the proposed tuition arrangements. A booking is only confirmed, and a contract between you and us is only formed, when we confirm the booking to you in writing by email.
5. Fees and Payment
Our fees, the payment method and the dates payment is due will be confirmed to you in writing before the first lesson. We will not charge you any amount that has not been agreed with you in advance. If our fees change, we will tell you in writing before the change applies to any future lessons, and you may end tuition before the new fees take effect.
6. Your Right to Cancel
If you book tuition at a distance (for instance, by email or online, without meeting us in person), you have a legal right to cancel within 14 days of the day we confirm your booking, without giving a reason.
- To cancel, email support@kesalzmentors.help with a clear statement that you wish to cancel.
- If you cancel within this period, we will refund any payment you have made within 14 days of receiving your cancellation, using the same payment method you used, unless we agree otherwise.
- If you ask us to start lessons during the 14-day cancellation period and then cancel, you will need to pay for the lessons already delivered up to the time you tell us you are cancelling.
After the 14-day period, you can still end tuition at any time by giving notice as described in section 7, and you will only pay for lessons that have been delivered or cancelled late.
7. Cancelling or Rescheduling Lessons
We understand that plans change. If you need to cancel or reschedule a lesson, please give us at least 24 hours’ notice by email.
- With at least 24 hours’ notice, we will reschedule the lesson or not charge for it.
- Lessons cancelled with less than 24 hours’ notice, or missed without notice, may be charged in full.
- For online lessons, if the student has not joined within a reasonable time after the agreed start time, the lesson may be treated as missed.
8. If We Need to Cancel
Occasionally we may need to cancel a lesson, for instance because of tutor illness or circumstances outside our control. If this happens, we will give you as much notice as possible and offer you a replacement lesson or a refund for that lesson, whichever you prefer.
9. Home Lessons
For home tuition in London:
- for students under 18, a parent, guardian or other responsible adult must be present at the home throughout each lesson;
- please provide a suitable, quiet space with a table and adequate lighting where the student can work without distractions; and
- please let us know in advance about anything the tutor should be aware of when visiting, such as pets or access arrangements.
10. Online Lessons
- For students under 18, the parent or guardian is responsible for appropriate supervision during online lessons and for making sure the student has a suitable device, working audio and a camera where needed, and a reliable internet connection.
- Lessons should take place in a suitable, quiet space at home.
- Online lessons are not recorded without consent. Where recording is proposed, we will ask for the agreement of the parent or guardian (and the student) first.
- If a lesson cannot go ahead because of a technical problem on our side, we will offer a replacement lesson or a refund for that lesson.
11. Safeguarding and Conduct
We take the safeguarding and wellbeing of students seriously.
- Contact between tutors and students under 18 happens only through arrangements agreed with the parent or guardian.
- We expect tutors, students and families to treat each other with courtesy and respect.
- Either party may end tuition immediately in the case of inappropriate, abusive or unsafe conduct.
- If you have any safeguarding concern, please contact us straight away at support@kesalzmentors.help. Where a child may be at risk, we may also need to share information with the appropriate authorities.
12. Progress and Results
We work to support each student’s progress, but because this depends on many factors, including the student’s effort, attendance and independent study, we cannot guarantee any specific outcome.
13. Intellectual Property
The content of the Website, including text, graphics and branding, belongs to Kesal Mentors or is used with permission. Lesson materials we provide are for the student’s personal, non-commercial use during their tuition and may not be copied, shared publicly or sold without our permission.
14. Limitation of Liability
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights as a consumer, including under the Consumer Rights Act 2015.
We will provide our services with reasonable care and skill. Otherwise, we are not responsible for any loss or damage that is not reasonably foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us when the contract was made. We provide tuition for domestic and private use only and are not responsible for any business losses.
15. Complaints
If you are unhappy with any part of our service, please email support@kesalzmentors.help with details of your concern. We aim to respond within 1–2 working days and will work with you to resolve the matter fairly.
16. Privacy
We handle personal data about you and the student in line with UK data protection law. Please read our Privacy Policy to find out how we collect, use and protect it.
17. Changes to These Terms
We may update these Terms from time to time. The latest version will always be on this page with the “Last updated” date shown at the top. Changes will not apply to lessons already booked unless we tell you in writing first, and if you do not accept a change that affects your tuition, you may end tuition without penalty before it takes effect.
18. Governing Law
These Terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland. If you live in Northern Ireland, you can also bring proceedings in Northern Ireland.
